Board updates STR ordinance (12-7-21)

At the Dec. 7, 2021, regularly-scheduled meeting, the Hot Springs Board of Directors passed Ordinance O-21-51, regulating short-term residential rental businesses (STRs) within the City of Hot Springs and amending ordinances No. 6375, No. 6382 and No. 6399. 

On March 2, 2021, the Board heard testimony from the public and adopted Ordinance No. 6375, pursuant to A.C.A. 26-77-102, requiring a business license for each “Short-term Residential Rental Business” within the corporate limits of the City. It also established an abeyance on all applications for STR licenses from 5 p.m. on May 30, 2021, until 5 p.m. on Oct. 13, 2021. 

On May 18, 2021, the Board adopted Ordinance No. 6382, establishing policies, rules and regulations for STRs within the City. 

On Oct. 5, 2021, the Board adopted Ordinance No. 6399, which amended Ordinance Nos. 6375 and 6382 and, in part, extended the abeyance on all applications for STR business licenses to Jan. 3, 2022. 

Since the adoption of Ordinance No. 6399, additional feedback has been received, prompting the following amendments: 

  • Removing requirement to obtain a Zoning Certification Letter 
  • Reducing the annual fee/occupation tax from $100 to $50 per person, per year, based on the maximum overnight occupancy authorized by the STR business license 
  • Requiring STR inspections to be completed by the City, as opposed to being done by a registered home inspector, which will reduce the costs for STR license applicants
